Pension Arrangements

Consultation on and the design of old age power of attorney and living wills is gaining importance.

In the case that the person concerned is unable to provide consent or unable to act in his or her own capacity, he or she can appoint a trusted representative, with power of attorney who can act for him or her, avoiding as much as possible official court-ordered supervision. The trusted third party will find it easier to implement the wishes of the incapacitated in such a case.

The selected person takes on the tasks in the areas of assets and health self-determination as a caregiver, without being subject to the strict rules of official care.

Advice is also often desired by the parties on the drafting of living wills (so-called advance directives).

Contrary to wills, power of attorney and living wills are effective during life, while the will only becomes legally effective after death.
